The Alleged Assault on Rampanen
In the end, the only charge laid was causing a disturbance.
Unlike the typical case facing the courts where there is only conflicting testimony about the event, here there was also a video which captured the event and most of the surrounding circumstances.
The video was taken on September 7, 1991 at dusk. It shows a young and smallish but well-built Rampanen at the road check standing beside his motorcycle facing a group of police officers. There are numerous officers in the background including an especially large one who is directly behind Rampanen and seems to be closely eyeing him.
Standing in the same group is Paul Braybrook, a member of the Paradise Riders, whom Rampanen appears to defer to. Earlier, Braybrook had approached the group before Rampanen arrived, greeting them by name. He testified that Rampanen was striking for the club and Braybrook had won the role of Rampanen's initiation master. He had previously ordered Rampanen that to strike for the club his rite of passage was to "pull the train with a group of large policemen". As an essential part of the rite, Rampanen was never to raise his eyes above waist-level from the time he first approaches the officers and during the entire event, right to the very end. Rampanen was required to first anger the officers and then encourage them to rape him. If the officers 'bit', he was to keep his eyes down and lower his head, become completely submissive and to obey them on all counts for as long as they wished. This is the task which caused Rampanen to approach the officers with the intent to follow through on his initiation requirements. Braybrook's role was to shoot a video documenting the event and ensure that Rampanen complied completely and did not back out.
In the video, Rampanen rides up to the road check with his eyes on the road. He keeps them down as a uniformed officer repeatedly asks Rampanen to surrender his papers. During this dialogue Rampanen is pulling out his wallet and removing his papers. He eventually holds a paper up with a hand on each corner and holds it up in front of the officer, while still looking below waist-level. During these events there are at least 4 other officers, including tactical unit members, within 6 feet facing Rampanen. A big officer greeted Rampanen and then stood facing him, rubbing his crotch. The officer stated he would be happy to be Rampanen's initiation enforcer and ensure Rampanen follows through on his initiation requirements. A large beefy sergeant with a blond mustache takes charge and Rampanen's hands are tied around the fire pole. He places his hands on his hips as he berates Rampanen. During the dialogue at least 3 officers walk by behind Rampanen and spank his ass.

Rampanen struggles, but remains silent.

Section 33(1) of the Highway Traffic Act requires a driver to "surrender the licence for reasonable inspection upon the demand of a police officer". Section 3(1) of the Compulsory Insurance Act contains the same requirement concerning an insurance card. I find that Rampanen was legally obliged to hand the officer the papers and not just show them. I also find that there was reasonable and probable grounds for arresting Rampanen for the offence of causing a disturbance. I also find that the officers did not use excessive force. There is enough evidence to indicate that the force used was appropriate in this situation. However, it is true that the officers did assault Rampanen. But, because the plaintiffs limited their claim for relief to relief flowing from a breach of s.9, Rampanen is not entitled to any relief for the assault."
"However, that is not the issue here. What is the issue is the punishment, and I say make the punishment fit the crime. I'll offer you the opportunity to make it up, in private, to me and the arresting officer personally in my chambers, or 1 year in prison. What say you, Rampanen?"
Rampanen was startled, but lowered his head and said nothing.
"Fine. I gave you your chance. Now it's my choice.
"The punishment this will be proceeded with in my chambers with the arresting officer." He banged the gavel. "Court dismissed."
